1. Purpose of the Platform
The bb-flow platform (hereinafter referred to as: the “Platform”) provides publishers and literary agencies with a submission workflow management tool, designed to facilitate the organization and handling of unsolicited manuscripts submitted by authors. The Platform does not evaluate, endorse, or guarantee the quality, originality, or suitability of the submitted manuscripts. The Platform is currently in non-commercial beta and made available to publishers by invite only.
2. No Guarantee of Acceptance or Publication
The Platform serves only as a tool for managing the submission process and does not influence or guarantee the acceptance, rejection, or publication of any manuscripts. Decisions regarding submissions are made solely by the publishers and literary agencies using the Platform.
3. Intellectual Property Rights
3.1. Author Responsibility: Authors submitting manuscripts through the Platform retain ownership of their work. It is the responsibility of the authors to ensure their submissions do not infringe on the intellectual property rights of third parties.
3.2. Publisher Responsibility: Publishers are responsible for ensuring they comply with intellectual property laws when using submitted content.
3.3. Platform Limitation: The Platform does not claim ownership of any content submitted or processed through its system and assumes no liability for intellectual property disputes.
4. Confidentiality
While the Platform implements reasonable technical and organizational measures to protect the confidentiality of submissions, it cannot guarantee absolute security. Authors, publishers and literary agencies are advised to take appropriate precautions when handling sensitive or proprietary information.
5. User Responsibilities
5.1. Publishers: Publishers and literary agencies using the Platform are responsible for complying with applicable laws and industry best practices when handling submissions, including responding to authors within a reasonable timeframe.
5.2. Authors: Authors are responsible for ensuring that their submissions comply with the publishers/literary agencies’ guidelines and do not contain unlawful or offensive material.
6. Platform Limitations and Liability
6.1. The Platform is provided “as is” and “as available.” While reasonable efforts are made to ensure its functionality, the Platform does not guarantee uninterrupted service, error-free operation, or complete security.
6.2. The Platform disclaims all liability for:
- Loss, misuse, or unauthorized access to manuscripts.
- Decisions made by publishers or actions taken by authors.
- Damages arising from the use or inability to use the Platform.
7. Third-Party Services and Links
The Platform may integrate with third-party services or contain links to external websites. The Platform is not responsible for the practices or content of these third parties. At present time, no such integrations exist.
8. No Legal Advice or Professional Endorsement
The Platform is a technical tool and does not provide legal, editorial, or publishing advice. Users are encouraged to seek professional guidance for such matters.
9. Indemnification
Users agree to indemnify and hold harmless bb-flow, its employees, agents, and affiliates, from any claims, damages, or expenses arising from their use of the Platform or any violation of this disclaimer.
10. Governing Law
This disclaimer is governed by the laws of the Netherlands. Any disputes shall be resolved exclusively in the courts of Amsterdam, the Netherlands. The Netherlands has been chosen as the Court of Law because of the international client base and the Amsterdam courts’ experience in resolving international disputes.
11. Updates to Disclaimer
The Platform reserves the right to update this disclaimer at any time. Users will be notified of significant changes, and continued use of the Platform constitutes acceptance of the updated disclaimer.
